Amend. XIV, No. 2, of U.S. Const, provides that representatives to congress "shall be apportioned among the several states according to their respective numbers, counting the whole number of persons in each state." Equal protection under the Fourteenth Amendment of the U.S. Constitution requires the allocation of representatives on a population basis and a justiciable issue is presented when a claim is made that states are denying right of representation to its citizens. Baker v. Carr, 369 U.S. 186, 82 S.Ct. 691, 7 L.Ed.2d 663.
